The United States Constitution's Eighth Amendment protects against cruel and unusual punishment [4]. The amendment was
added to the Constitution to ensure that the government does not abuse its power [3]. The amendment guarantees that those accused of a crime should not be given cruel and unusual punishment while in prison.
In addition to protecting against cruel and unusual punishment, the Eighth Amendment also prohibits excessive bail and fines [2]. The Supreme Court has been required to decide what types of penalties fall under the definition of cruel and unusual, and the interpretation of this definition has changed over time [3]. When an inmate makes an Eighth Amendment challenge to punishment and confinement conditions, they typically do so in connection with federal civil rights laws, including the 42 U.S. Code, Section 1983, and the Prison Litigation Reform Act [1].
